Thanks for asking mate.
In a word, no. There has been no bloody progress on this for about 2 months now and I'm just about reaching the end of my tether over it.
As you will have seen from my previous posts, the builder's solicitor has advised that they think he is due another £10000 on top of the £8000 of mine he's already had (despite the fact that he did precisely nothing of the building work).
At the beginning of December I wrote and asked for a full written breakdown of the figure, detailing how much he claims was spent etc etc and to date, we have not had a response. I spoke to his solicitor on 8 January and was assured that they would be responding "shortly". I've been corresponding by email with them and I've checked tonight. Still no response.
It's time to get nasty as far as I'm concerned. They obviously don't want to deal with it, or they don't think he has much of a case. As far as I'm concerned, I've been sufficiently patient and polite in my dealings with them. Well, now it's time for them to put up or shut up. If they can't/won't provide the breakdown I have requested, I'll simply have to go to court and see what a judge has to say.
I'll keep you informed.

Blimey FA. They say he who hesitates is lost, but when you think where your moment of rashness has led you to.......... You are in a dreadful situation . I wish you all the luck in the world. I think you're gonna need it

OH god FA, I purposely didn't bring this thread up for fear of upsetting you, and I was dying to know what was happening, but I knew it wouldn't be good or you would have said, Do you think they are trying to get you to drop it all, by saying it will cost more than you have already laid out. and like NO, I also wish you good luck with it, I don't know what else to say .

To be honest, I'm not in the least bit surprised at the way this has turned out. It's typical of my life, unfortunately. I'm always in the sh*t one way or another, only the depth varies.
I emailed his solicitor last night and haven't had a response today. If I don't hear from them in 7 days, I'll have to begin court action.

I'm so sorry for you - its really shit how some builders treat customers. I wouldn't bother emailing his solicitor and although I know its expensive - get on to yours and make them earn some money. If he has done no work at all - there is no way he would of had to lay out that amount of money - the thieving T**t. From my experience builders have accounts at the builders merchants and stuff thats been ordered and not required is returned and just gets knocked off the bill. Karl and Danny are always over estimating materials required and there is never a problem with returns. He is a git and I hope you take him for every penny he has and then some

Thanks KL. I'd settle for getting a large chunk of my own money back, although it would give me immense pleasure to take him for some more too.

Its just not fair is it. I spoke to Karl about it when it all first blew up and he said if it had been their firm they would have given the money back maybe minus £500.00 for the inconvience, but all this talk of 10 grand for loss of earning is b@llocks (if you will pardon my expression) If he couldn't find a job to fill in the gap he must be some sort of shit builder. Karl and Dan are really struggling for work, but since this recession hit they have only had a matter of days with no work at all - admittedly they not earning the money they used to, but my point is they are good builders and trust worthy so people use them. Im so sorry you got involved with a shyster FA. You deserve better.

They have changed what they said in previous correspondence and in my opinion, have misled me.
My solicitor will be getting a call in the morning.

Morally, yes, legally, I don't know. That's what solicitors are for.
I don't hold out any hope of getting any money back but I'm damned if I'm going to let him have £8000 of my money without costing him a fair amount in solicitors fees first.

Oooooo good idea - there is also a programme on 4 or 5 about dodgy builders. Never do programmes about good builders tho do they and before you all start some of them are good blokes

Hello mate
Thanks for asking. In all honesty, it's not progressing very quickly but I have tried to move it on since the last time I posted.
I discussed their last letter with my solicitor. In the first letter, the solicitor claimed that the idiot builder had incurred expendture on bricks, steelwork, skips etc and had engaged subcontractors to do the job, which was, essentially, a load of old cobblers.
I asked for them to breakdown the amounts he'd spent on each item and provide evidence of the expenditure incurred.
Then then eventually wrote again 7 weeks after my original request for the breakdown and the evidence to say that his claim against me was for damages due to "loss of profit on the job".
In other words, "we told you he'd spent a load of money to try and scare you off but as that didn't work, we'll try something else".
I've now responded to that letter with one of my own, making them aware of a number of things that I'm sure he wouldn't have told them.
There are too many to go into on here and I don't want to reveal my legal position too closely because you never know who's watching. Suffice it to say, my letter chucked a bit of a spanner in his works and gave them something to chew on ;D
I'm now waiting for a response but as it's only been 3 weeks, I don't expect anything for a little while yet.
I'll keep you posted.
